Rob — Hot off the press. SCOTUS just made it way more difficult for people to challenge congressional redistricting based on alleged racial discrimination. I mean way more difficult — in my view, nearly impossible. Highlighted and annotated SCOTUS opinion attached.
Facts: After the 2020 census, Louisiana redrew some congressional districts. A coalition of black voters challenged the plan, claiming that it diluted black voting power. A court agreed and invalidated the plan. So Louisiana wrote a new plan that specifically accounted for race and protected black voting power — just as the court required. A group of non-black voters challenged this new map, saying that it was expressly race-based and therefore unconstitutional. These non-black voters won, and the case made its way to SCOTUS.
Issue: The people who favored the new, race-conscious plan pointed to the Voting Rights Act, which prohibits racial discrimination in voting and is intended to enforce the 15th Amendment. But the plaintiffs — the non-black voters — did some jiu jitsu and pointed out that Louisiana's new redistricting plan violated these very laws because it was expressly race-based. SCOTUS agreed with the non-black voters.
Holding: The VRA did not require Louisiana to create a special district to protect a minority's voting bloc. Therefore, the new map is an unconstitutional race-based gerrymander.
Why race-based challenges will be really hard going forward: No more redistricting based on race. 'Disparate impact' is dead. Most cases are partisan disputes dressed as racial. Federal courts will turn partisan grievances away. The biggest blow: plaintiffs must produce alternative maps that fully achieve the state's legitimate policy goals, don't use race as a criterion, and control for party affiliation. Given that blacks tend strongly to vote as a Democrat bloc, this will be way harder than it sounds. Indeed I think it'll prove nearly impossible.

Sorry for the late email. I have been saying that I was going to reach out to you guys for months now. The highlight is that I have never been closer to God than I am now, and I was raised Catholic! You guys actually play a role in this. Along with No Agenda, Curry & The Keeper, and We Get to Do This. God keeps putting things and people in front of me, and I just keep saying, 'This is what he wants me to do.' So I say YES. Everything has taken off! The NICU Dad is global, launched an Amazon bestseller, and the family is amazing. I just keep putting my 100% faith in the Lord, and he comes through every time!
How I do things in the NICU, I have done for our local school district. I was born and raised in Hays County. I've been in the PTA, SHAC, FBOC, and other committees for years. I was asked to run for the school board in the last election. I declined because I was too busy. I was asked for this election, and I am even busier, but given the current financial difficulties our schools are facing, I felt I didn't have a choice.
Adam talks about running for Mayor, I figured if he would if he could. The reality is that I am the best candidate for the job, and am a bit of a unicorn. I check ALL of the boxes. Five generations in the area. Four generations in Hays CISD. Years of experience. Not to mention my last name is Zavala. Lol.
But I'm no agenda. I have been very vocal about keeping political parties out of non-partisan positions. I am the only candidate who is not endorsed by a political party. The Dems have their candidate, and the Moms for Liberty have theirs. I'm pretty sure I am going to win, but let's go with God willing. I'm sure I am not the first No Agenda Party candidate, but here we go!
